Stuck With A Damn Lawyer
Are you stuck with a DAMN LAWYER? Do you feel betrayed with bad advice? Is your lawyer more interested in the green than you?
Well, you’ve come to the right place. We want cameras in the courtrooms, an end to cozy courthouses, and judges who rein in unnecessary legal bills. And we want Caroline and Rich Allison to get the justice they’ve been denied.
Stuck with a Damn Lawyer
Our Damn Lawyer investigation has focused on how just a couple of lawyers who say took advantage of a brother and sister trying to find out how much inheritance their dead father left them.
It’s become an ugly battle, allegations of fraud, a biased arbitrator who hid conflicts of interest, you shouldn’t be stuck with a Damn Lawyer!
Now more clients of Nick Abaza.
Jorge Borunda and Michael Trevino are showing us there is a deeper web to be exposed too.
“I think it’s against the law from what they’re doing,” said Devon Kuhnel.
“She raised me since birth,” Devon Kuhnel said.
Devon Kuhnel’s grandma Billie died in 2018; she had millions of dollars in mineral rights.
“She wrote a will splitting things in three ways. My uncle, my father, and me, I’m the grandson,” said Devon Kuhnel.
Jorge Borunda and his law partner Adam Fomby are the lawyers for the estate and the executor.
Two years after Billie’s death, the will was challenged by a husband she’d been estranged from for more than 30 years.
Devon’s grandfather Roy just happened to hire Borunda’s buddy, “the will contest guy,” Michael Trevino.
“He went into the office with intentions to retain him on an hourly fee basis, but my grandfather, he’s 83 years old, and he don’t really understand what’s going on too well, and all I know is he came out with a contingency deal,” said Devon Kuhnel.
Trevino is working on contingency, but Devon says Borunda’s been working on an hourly fee basis. The longer it goes, the more he makes.
But the estate work has gone on 8 years now; Borunda’s good buddy Trevino is making sure the legal fees come in.
“I looked up the code of ethics, and the code of ethics says that attorneys in the same law firm can’t represent opposing sides in a lawsuit. And that’s exactly what’s going on right now,” said Devon Kuhnel.
Borunda and Trevino are not in the same law firm, but they have identical office addresses, here on 12141 Wickchester Lane.
But Trevino used to work in Borunda’s law firm.
Trevino is also working in opposition to Borunda and Abaza in the Harris County estate case of James Fletcher.
When you saw lawyers working together, and then against each other, did you know about the potential conflicts?
We’ve been reporting on damn lawyers after a brother and sister say they were cheated by the trio for millions.
We’ve exposed clear evidence that the arbitrator chosen to handle their dispute had too many conflicts.
“They’re a legal gang, and they stay separate because that way they could be operators. They could get on both sides of the case,” said Caroline Allison.
“I started searching Michael Trevino’s name up online, deep searching, and the Damn Lawyer’s investigation popped up on Google,” said Devon Kuhnel.
“I want for it to be common knowledge that attorneys prey on families, and they love inheritances because dead people can’t defend themselves,” said Caroline Allison
The Allisons came to us to investigate what their own lawyers did to them, because we aren’t afraid of lawyers.
“Why should the Allisons pay for your bad advice?” said Andrea Palacio.
“Ha,” said Jorge Borunda.
“I watched them. They were alarming, so I sent everything to my uncle. I’m like, these are the lawyers that you’re dealing with, you know?” said Devon Kuhnel.
“He told me that the same thing that he watched, that’s what he’s experienced in his case. All the lies, deception, and misguiding and everything like that,” said Devon Kuhnel.
“I hired him in January, and here it’s September, and he’s done nothing. But he knows all the money that my parents have, and I’m, you know, I’m scared now,” said Matthew Reagan.
This guy called our office worried about Abaza; we’ve been dealing with these guys for fake reviews inflating their reputation.
“I’m really at a loss of what to do here,” said Matthew Reagan
Abaza got a one-star review on Birdeye 6 months ago.
He supposedly missed an important filing deadline, couldn’t remember his client’s name in court.
The review included screenshots from our Damn Lawyers investigation.
And via text message, someone still hoping Abaza will do his job told us.
“When the time is right, I will be more than happy to share my horrible, frustrating, and stressful experience with him over the past three years.”- Anonymous.
Yet somehow Nick Abaza got named by H-Town Best as a top probate lawyer. Looks like he wrote his own press release.
The Allisons spoke recently to the Texas State Bar.
“I think that the state bar really needs to examine how their mechanisms are, so that if you do have a bad attorney or issues with an attorney, that it needs to be handled a lot better than what you have right now,” said Rich Allison.
So far, only arbitration Judge Anne Ashby is under investigation that we know of, but Allisons have filed bar grievances against all three of the lawyers.
The state bar has something new to consider about Jorge Borunda. Whether he practiced law without a license.
For the entire month of September, Borunda was not eligible to practice law in Texas.
He was three months late paying his bar fees. But he practiced law anyway.
On September 14, Borunda and co-counsel Michael Trevino signed a response in another estate case.
Kathy Marcoux is one of their clients.
“We see that he filed a brief to the court this month. And we wanted to find out if you knew that his state bar license is under suspension,” said Andrea Palacio.
“I don’t know anything about what you’re talking about. I have no idea,” said Kathy Marcoux.
“But you know who I’m talking about, Mr. Borunda?” said Andrea Palacio.
“What I need is your name,” said Kathy Marcoux
She was a little unhappy to hear from us, but all we did was share public information. The state bar website.
We can also tell you that when we started our investigation, estate work was all that Borunda did.
Now he sells himself as a personal injury lawyer.
One of our investigators tried to hire Borunda. He rejected the request to handle her probate issue, saying it wasn’t within his scope of work. Borunda said he could not recommend anyone who could help.
Wow, but these guys are still working together on other cases. Working to collect more than four million dollars from Allisons case.
Caroline and Rich both testified in Austin before the Senate Committee on State Affairs. Judge Cory Sepolio has been asked to reconsider his recent ruling that finding alleged fraud in the case was simply found to be too late. That can’t be fair.
Sepolio has scheduled a meeting for October 23, and we want everyone to be able to watch. The 269th is on the 13th floor of the Civil Courthouse. Let the sunshine in, Judge, and hold these damn lawyers accountable for advice that looks pretty darn self-serving.
“Arbitration benefits the attorneys, because an attorney is the decider,” said Caroline Allilson.
“I would be very in favor of making it very difficult for an attorney to screw up and not be held accountable,” said Senator Bob Hall.
Senator Bob Hall thinks some of the scandals in family court wouldn’t have happened if there were cameras in all Texas courtrooms, recording every word said, a way to judge the judges. We agree.
“Knowing that their every move and every word is being recorded will cut down on some of the bad behavior that goes on between judges and one of the two attorneys,” said Bob Hall.
Too many people have been screwed in court.
It’s time for judges to stop the lawyers who take advantage of the people who trust them.
