Unsealing the Truth
We’re back in Waller County Tuesday morning as the judge begins to decide what else can be made public in the NewQuest founder’s divorce case.
“Oh boy… We get to go back to Waller County. Were suing folks there… Looking Forward to it,” said Wayne Dolcefino.
“Before, when Judge Kern was presiding, it did seem like he placed the burden on the public to establish their right to view sealed records, whereas the correct analysis is that the burden is on the proponents of sealing to show why public records should be sealed,” said Nick Kacal.
“And so that reversal of who has the burden has really put a substantial change in the frustrations on the parties,” said Nick Kacal.
“It makes Sears Council and the NewQuest Council work harder because they can’t sit back and say, hey, it’s sealed, they have no right. They have to come forward with legal arguments and evidence on why this information shouldn’t be public. And they don’t have that. And so, their former arguments are really falling flat in a lot of places,” said Nick Kacal.
